SimpliPerks Terms of Service

Effective Date: March 1, 2026

These Terms of Service (“Terms”) govern your access to and use of the SimpliPerks mobile application, website, and related services (collectively, the “Service”) operated by SimpliPerks, LLC.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

These Terms are governed by the laws of the State of Utah, United States, without regard to conflict of law principles.

2. Description of the Service

SimpliPerks provides members with access to consumer discounts and promotional offers including but not limited to:

Travel discounts
Cruise discounts
Shopping discounts
Dining discounts
Entertainment discounts

Many offers are made available through Access Development, a third-party provider of discount and loyalty programs.

SimpliPerks does not operate, own, or control participating merchants, travel providers, or offer providers. Discount availability may vary by geographic location and merchant participation.

3. Eligibility

You must be at least 18 years old to create an account or use the Service.

By using the Service you represent that:

The information you provide is accurate and complete
You have the legal authority to enter into this agreement

4. Accounts

Certain features require you to create an account.

You agree to:

Provide accurate and complete information
Maintain the security of your login credentials
Notify SimpliPerks immediately of unauthorized account activity

You are responsible for all activity under your account.

5. Membership Types

SimpliPerks offers two primary membership types.

Free Membership

All registered users receive free access to travel and cruise discounts for life provided that SimpliPerks continues to operate and provide the Service.

Paid Membership

Paid members receive additional discounts including shopping, dining, and entertainment (“Eat, Play, Shop” discounts). The current price for a paid membership is $36 per year.

SimpliPerks reserves the right to modify membership pricing or benefits at any time.

6. Subscription Billing

Paid memberships may be purchased through:

The SimpliPerks website
The Apple App Store
The Google Play Store

Subscriptions automatically renew annually unless canceled before the renewal date.

When purchased through Apple or Google:

Billing is handled by the platform provider
Platform billing terms apply
Refund requests must follow the platform provider’s refund policies

7. Cancellation Policy

Members may cancel their paid membership at any time.

Cancellation prevents future billing but does not terminate the current subscription period.

After cancellation, users will continue to receive free travel discount access but will lose Eat, Play, Shop benefits when the paid membership expires.

8. Refund Policy

Refunds may be requested within 30 days of the initial purchase if:

The user has never redeemed a discount
The user has never presented a coupon or offer to a merchant

Refund requests must be submitted to Support@simpliperks.com.

No prorated refunds are available after the first 30 days.

Subscriptions purchased through Apple or Google must follow their respective refund policies.

9. Employer-Sponsored Memberships

Employers may provide SimpliPerks memberships to employees.

Employer memberships:

Remain active while the employee remains eligible
May be terminated when the employer notifies SimpliPerks that the employee is no longer eligible

Employer memberships are not transferable and are associated with the employee’s personal email address.

10. Third-Party Discounts and Merchant Participation

Discounts are provided by participating merchants, travel providers, entertainment venues, Access Development, and other partners.

Merchants may change or discontinue offers at any time.

Offers may vary by location and availability.

SimpliPerks does not guarantee offer availability, merchant participation, pricing accuracy, or acceptance of discounts.

11. Merchant Disclaimer

SimpliPerks is not responsible for the products or services provided by participating merchants. Any transaction between a user and a merchant is solely between the user and that merchant.

SimpliPerks is not liable for merchant refusal to honor offers, service quality, travel disruptions, reservation issues, pricing errors, or merchant closures.

12. Acceptable Use

Users agree not to:

Share login credentials
Transfer or resell memberships
Use discounts for commercial resale
Scrape or copy platform content
Use the Service for fraudulent purposes

Violation may result in account termination.

13. Intellectual Property

All trademarks, branding, technology, and content associated with the Service are owned by SimpliPerks, LLC or its licensors.

Users may not reproduce, distribute, or modify any part of the Service without written permission.

14. Suspension or Termination

SimpliPerks reserves the right to suspend or terminate accounts if:

These Terms are violated
Fraudulent activity is suspected
Payment fails
Platform abuse occurs

15. Limitation of Liability

To the maximum extent permitted by law, SimpliPerks shall not be liable for indirect damages, lost savings, travel disruptions, merchant disputes, or inaccurate discount listings.

The Service is provided “as is” and “as available.”

16. Indemnification

You agree to indemnify and hold harmless SimpliPerks, its affiliates, partners, and employees from any claims arising from your use of the Service, violation of these Terms, or disputes with merchants.

17. Changes to Terms

SimpliPerks may modify these Terms at any time. Updated Terms will be posted on the website or application. Continued use of the Service constitutes acceptance of the updated Terms.
